1. LEGAL INFORMATION AND ACCEPTANCE

These Terms of Service ("Terms") govern the use of the website www.oceansgolfbuggies.com and the sale of products by Oceans Golf Buggies ("We," "Us," or "Our").

By accessing our website or purchasing our products, you agree to be bound by these Terms. These Terms are drafted in accordance with Spanish regulations, specifically the Law on Information Society Services (LSSI) and the General Law for the Defense of Consumers and Users.

2. PRODUCTS AND AVAILABILITY

We sell electric utility vehicles, golf buggies (both standard and road-legal), and associated parts.

• Product Descriptions: We aim to describe and display our products as accurately as possible. However, slight variations in color or design may occur. The images on the website are for illustrative purposes.

• Road Legal Vehicles: Certain models (such as the Z2 series) are designated as "EEC Street Legal." While these vehicles meet the manufacturing standards for road use in the EU, they must be registered with the DGT (Tráfico) and pass the ITV to be driven on public roads in Spain.

• Availability: All orders are subject to acceptance and availability. If an item is out of stock, we will notify you immediately and offer a refund or a delivery estimate for the next shipment.

3. PRICING AND PAYMENT

• Currency: All prices are shown in Euros (€).

• IVA (VAT): Unless otherwise stated, prices displayed on our website include Spanish IVA (Impuesto sobre el Valor Añadido) at the current applicable rate.

• Payment Methods: We accept various payment methods as displayed at checkout.

• Deposits and Balance: For high-value items or pre-orders where the stock is not yet in Spain, we may accept a partial deposit to secure the vehicle, with the remaining balance due prior to final delivery or collection.

4. SHIPPING AND DELIVERY

• Territory: We primarily ship to addresses within mainland Spain. For shipping to the Balearic Islands, Canary Islands, or other EU countries, please contact us for a quote.

• Delivery Process: We pride ourselves on a "door-to-door" service. We handle the logistics to get the buggy to you.

• Inspection: Upon delivery, you are responsible for inspecting the goods. If the packaging or the vehicle appears damaged, you must note this on the delivery note and contact us immediately.

• Risk: The risk of loss or damage to the goods passes to you once you (or a third party indicated by you) acquire physical possession of the goods.

5. ROAD LEGAL REGISTRATION (Matriculación)

For models sold as "Road Legal" (e.g., Z2):

• Documentation: We provide the necessary manufacturing documentation (EEC Certificate of Conformity) required for registration.

• Service: As stated on our website, we have experience assisting with the "minefield" of paperwork. However, unless explicitly agreed as a "Turnkey" (Llave en mano) service in your specific invoice, the ultimate responsibility for maintaining the legal status of the vehicle (insurance, valid ITV, taxes) rests with the customer.

6. WARRANTY AND LIABILITY

A. Legal Guarantee

We provide a 3-year legal guarantee on all new products in accordance with Spanish Consumer Law, covering lack of conformity at the time of delivery.

B. Commercial Battery Warranty

Our Lithium Batteries come with a specific 5-year warranty (3 years full replacement, 2 years prorated).

• Voiding the Warranty: This warranty is void if:

• You fail to follow the "Break-in" procedure (first 10-20 charge cycles) as outlined in our FAQ/Manual.

• The battery is discharged below 20% regularly.

• A non-authorized (non-Oceans Buggies proprietary) battery is installed.

• There is tampering with the charger algorithms.

C. Limitation of Liability

Oceans Golf Buggies shall not be liable for:

• Any indirect or consequential losses (e.g., loss of profit).

• Damage caused by misuse of the vehicle (e.g., off-roading in a non-utility vehicle, or driving a non-road-legal buggy on public highways).

7. RETURNS AND CANCELLATION

You have the right to cancel your contract within 14 calendar days of receiving the goods without giving any reason.

• To exercise this right, you must notify us in writing.

• The vehicle must be returned in its original condition.

• The customer is responsible for the cost of return transport to our facility.

8. INTELLECTUAL PROPERTY

All content on this website (text, images, logos, product names) is the property of Oceans Golf Buggies or its licensors. You may not use, reproduce, or distribute this content without our express written permission.

9. GOVERNING LAW AND JURISDICTION

These Terms are governed by Spanish Law.

• In the event of a dispute, if you are a consumer, the courts of your place of residence shall have jurisdiction.

• If you are a business/professional, the courts of the registered office of Oceans Golf Buggies shall have jurisdiction.
